The 29-year-old was arrested after an incident in Bath on Saturday and was held on suspicion of causing grievous bodily harm, then released on bail until Thursday.
The former rugby league man's bail has been extended until mid-November with a Gloucester spokesman saying that Vainikolo would be considered for selection against Newcastle on Sunday.
Elsewhere, Harlequins hooker Ignacio Elosu has been cited for allegedly stamping on an opponent during his side's EDF Energy Cup defeat against London Irish last Saturday.
He will face a Rugby Football Union disciplinary hearing on a date to be announced.
