The 29-year-old centre, one of both club and country's key players is now due before Magistrates in Reading on May 14.
No one at Gloucester Rugby Club was available for comment on Wednesday.
Meanwhile, London Irish have signed James Buckland, the former England Under 21 and England A hooker, on a two-year contract from London Wasps.
Buckland moved to Wasps from Leicester Tigers last summer, but has not been able to crack a regular first-team place.
“The demands on our front row are such that it is essential we have strength in depth in each position,” said Exiles Director of Rugby Brian Smith.
“We have to plan for international call-ups and injury and are pleased to have been able to recruit a player like James who has invaluable experience of competing at the highest level in this country and Europe.”
