The Kiwi was dismissed in the final minutes at Kingsholm after being shown a second yellow card by match referee Tony Spreadbury.

But, because both offences were technical and not foul play, Herring will not face an RFU disciplinary panel and is free to take to the field in Sunday's Guinness Premiership clash at London Irish.

Meanwhile, the Tigers are likely to be without lock Marco Wentzel until the middle of April.

The 28-year-old South African second-row forward departed Kingsholm with a suspected broken ankle which forced Martin Corry to join fellow back row Tom Croft at lock for the majority of the game.

Doctors later said there was no break but have diagnosed ligament damage which will keep the 28-year-old on the sidelines during February, March and the first part of April.

“It's disappointing for us and Marco that he will be out of action for two months,” said forwards coach Richard Cockerill, speaking to the Leicester Mercury.
