@APV1 - The only other thing might be a "gentlemans agreement " between the Premiership clubs not to poach each others staff and players - but I doubt it.

@ Headhunter99 - thank you. It does help to clarify the situation. I suppose the only issue might be if Sale specificallyasked the recruiter to include BR in their list of potentials. And we don't even know if Sale used a recruiter, or just put the feelers out on their own.

Either way, how would anyone know what was in BR's contract? If he's contracted not to enter into discussions (which must be pretty tough to agree to, let alone enforce), then any fault would lie with him for not walking away.

This is, of course, all guesswork and supposition. Maybe we'll never know...

@APV1 - If Sale retained a recruiter and gave them a full brief, there is nothing to prevent that recruiter approaching an employee of one of their clients competitors. Provided that the recruiter can prove they instigated the contact.

Secondly, I cannot think of any legal barrier that would stop any individual resigning from their job to go and work for competitive organisation. OK, restrictive covenants will probably be in place to stop further poaching by the outgoing staff member and the use of confidential information for a period of 6-12 months. If Sale did approach him direct, Gloucester have the right to feel mighty P****d off but thats about all.

Basically I agree that this is a bit of sabre rattling and sour grapes.

@sanka69 - Provided the recruiter does not have a legal agreement precluding them from approaching an organisations employees they can speak with whoever they wish. Face it if I approached you with a better job with a better salary and prospects I bet you'd want to talk.

Doesnt sound like sour grapes to me, sounds like a perfcetly reasonable argument - If Sale had appointed a recruiter who approached somebody under contract then they are at fault I would guess!

@ Headhunter99 - if you read this, perhaps you can shead some light on the intricacies of recruitment protocols? This all smacks of sour grapes from Gloucester, but perhaps they're well within their rirghts...
